Xinjiang Communications Construction Group Co.Ltd(002941) (hereinafter referred to as “the company”) recently received the decision on administrative punishment of natural resources from Altay Natural Resources Bureau (Ashi natural resources punishment decision [2021] No. 2, hereinafter referred to as “the decision”), and now the relevant information is announced as follows:
1、 Main contents
(I) decision
The company mined Gobi materials across the border in dablehart village, khandgart Township, Altay City, and mined sand and stone beyond the approved scope. The above facts violated the provisions of Article 3 of the mineral resources law of the people’s Republic of China and Article 32 of the measures for the administration of mineral resources mining registration, and in accordance with Article 40 of the mineral resources law of the people’s Republic of China Paragraph 2 of Article 42 of the detailed rules for the implementation of the mineral resources law of the people’s Republic of China and Article 68 of the notice of the Ministry of public security of the Supreme People’s Procuratorate on printing and distributing the provisions of the Ministry of public security of the Supreme People’s Procuratorate on the standards for filing and prosecuting criminal cases transferred by public security organs (I). 1. Order to stop illegal mining; 2. Confiscate the illegal income of 19411373 cubic meters of Gobi materials 5 yuan / cubic meter = 97056865 yuan 3. Impose a fine of less than 30% of the illegal income: 291170595 yuan. Administrative penalty totaling 1261739245 yuan.
2、 Impact on the company
According to the situation identified in the decision, this administrative punishment does not touch the major illegal compulsory delisting specified in articles 9.5.1, 9.5.2 and 9.5.3 of the Listing Rules of Shenzhen Stock Exchange. This event will not have a significant impact on the issued convertible corporate bonds and the current performance of the company, and will not affect the continuous operation of the company.
