Recently, Jiangxi Yongxing special steel new energy technology Co., Ltd. (hereinafter referred to as “Yongxing new energy”), a wholly-owned subsidiary of Yongxing Special Materials Technology Co.Ltd(002756) (hereinafter referred to as “the company”), received the civil judgment of Nanchang intermediate people’s Court of Jiangxi Province, No. (2021) Gan 01 Zhi min Chu No. 43, Nanchang intermediate people’s Court of Jiangxi Province has made a judgment of first instance on the dispute case of Ganzhou Yatai Tungsten Industry Co., Ltd. (hereinafter referred to as “Yatai tungsten industry”) v. Yongxing new energy for infringement of invention patent right. The specific circumstances are as follows:
1、 Basic information of the proceedings
Yatai tungsten industry believes that the lithium carbonate production process technology used by Yongxing new energy is completely the same as its patent technical characteristics, which constitutes an infringement of its patent right, according to the project contents publicized for the first time in the environmental impact assessment of Yongxing new energy’s “10000 t / a battery grade lithium carbonate project” and the relevant statements in the Yongxing Special Materials Technology Co.Ltd(002756) 2019 annual report, Therefore, a lawsuit for infringement of invention patent right was filed with the people’s court, requiring Yongxing new energy to immediately stop the infringement. 2、 Progress of the proceedings
Recently, Yongxing new energy received the civil judgment of Nanchang intermediate people’s Court of Jiangxi Province, No. (2021) Gan 01 Zhi min Chu No. 43. The judgment is as follows:
1. Reject all claims of Yatai tungsten;
2. The case acceptance fee of 1000 yuan (paid in advance by Yatai tungsten) shall be borne by Yatai tungsten;
3. If you are not satisfied with this judgment, you may, within 15 days from the date of service of the judgment, submit a petition of appeal to this court, submit copies according to the number of opposite parties, and appeal to the Supreme People’s court.
