2、 Facts, reasons and claims
(I) litigation facts and reasons
On May 19, 2021, the plaintiff signed the general construction contract with the company. On June 2, 2021, the company issued a commercial bill with a payment amount of 167663226.76 yuan to the plaintiff according to the general construction contract, and the maturity date of the bill is September 2, 2021.
Up to now, the company has not paid the remaining amount as agreed, and still owes the plaintiff 55663226.76 yuan for the project.
(II) claims
1. Order the company to pay the plaintiff the amount of the project payment in arrears of 55663226.76 yuan and the liquidated damages calculated at the interest rate of 0.03% per day from September 3, 2021 to the date of full payment;
2. Order the company to compensate the plaintiff for the lawyer’s fee of 584879 yuan and the guarantee fee of 47258.233 yuan;
3. Order the defendant 2, the defendant 3, the defendant 4, the defendant 5, the defendant 6, the defendant 7, the defendant 8 and the defendant 9 to bear joint and several repayment liabilities to the plaintiff for the above-mentioned debts of the defendant 1;
4. The court costs, acceptance fees, preservation fees and announcement fees of the order shall be borne by the defendant.

Recently, the company received the civil ruling on the property preservation of this lawsuit issued by Shanghai Songjiang District People’s Court (2021) Hu 0117 min Chu No. 20611), and ruled to freeze Dr.Peng Telecom&Media Group Co.Ltd(600804) , Beijing Telecom Engineering Co., Ltd Beijing Zhongbang Yatong Telecommunication Technology Co., Ltd., Beijing Changkuan Telecommunication Service Co., Ltd., Beijing Broadband Telecommunication Technology Co., Ltd., Beijing Guoxin Bilin Communication Technology Co., Ltd., Beijing Telecom tongchangda Information Co., Ltd., Beijing Changkuan Communication Service Co., Ltd. and Yang Xueping deposit 59072788.12 yuan in the bank or seal up or detain the property with corresponding value. Up to now, the bank account of Beijing broadband Telecom Technology Co., Ltd., the fifth defendant in this lawsuit, has been frozen before the lawsuit, and the actual frozen amount is 59072788.12 yuan.
