It is understood that Shanghai market supervision and Administration Bureau received the clues handed over by Shanghai Municipal Commission of Commerce and reported that Yunda freight did not disclose information in accordance with the regulations when carrying out franchise activities, so it filed a case for investigation.
After investigation, Yunda freight carried out “Yunda” express franchise activities in the form of recruiting franchise outlets and signing “franchise (franchise) contract”. In July 2018, when Yunda freight signed a franchise contract with a logistics company, it failed to provide the franchisee with the information specified in Article 22 of the regulations on the administration of commercial franchise in writing at least 30 days before the date of signing the franchise contract.
According to the data, Article 22 of the regulations on the administration of commercial franchising includes the name, domicile, legal representative, registered capital, business scope and basic information of franchising activities of the franchisor; The basic information of the franchisor’s registered trademark, enterprise logo, patent, proprietary technology and business model; The type, amount and payment method of franchise fees (including whether to collect the security deposit and the return conditions and methods of the security deposit); Prices and conditions for providing products, services and equipment to the franchisee; Provide the franchisee with the specific contents, provision methods and implementation plans of business guidance, technical support, business training and other services.
According to Yunda freight, from March 2011 to the crime, Yunda freight failed to provide the franchisee with the information specified in Article 22 of the regulations on the administration of commercial franchising at least 30 days before the date of signing the franchise contract when signing the franchise contract with more than 4000 franchise outlets.
On January 5, 2022, Shanghai market supervision and Administration Bureau delivered the notice of administrative punishment to Yunda freight. Shanghai Municipal Bureau of market supervision and administration believes that Yunda freight failed to provide the franchisee with the information specified in Article 22 of the regulations on the administration of commercial franchising in writing at least 30 days before the date of signing the franchise contract, In violation of Article 21 of the regulations on the administration of commercial franchising, “the franchisor shall provide the franchisee with the information specified in Article 22 of these regulations and the text of the franchise contract in writing at least 30 days before the date of signing the franchise contract”.
Shanghai market supervision and Administration Bureau ordered Yunda freight to correct the above illegal acts and decided to impose a fine of 40000 yuan on Yunda freight.
