Article 1. These Provisions are formulated in accordance with the requirements of the notice of the Ministry of culture and tourism on deepening the reform of “release, management and service” and promoting the prosperity and development of the performance market, in order to guide the city’s secret rooms and cultural business units to standardize their operation, carry forward the socialist core values, and maintain the national cultural security and ideological security.
Article 2. The “secret room script killing cultural format” as mentioned in these Provisions refers to the form of cultural experience that provides one or more scripts, secret rooms of organs and real scenes based on a certain story, mainly based on logical reasoning, for interaction between consumers or between consumers and site staff. The business entity of secret chamber script killing culture business as mentioned in these Provisions refers to the business entity engaged in the above-mentioned secret chamber script killing culture business for the purpose of profit.
Article 3 the business units of secret rooms and cultural formats shall adhere to serving the people and socialism, adhere to the creative transformation and innovative development of Chinese excellent traditional culture, and enrich the spiritual and cultural life of the people.
Article 4 the Shanghai Municipal Bureau of culture and tourism shall be responsible for the supervision and administration of the contents of the city’s secret chamber scripts and cultural formats, establish a script review expert group and issue a list of illegal scripts. Guide the cultural and tourism bureaus and industry organizations of all districts to carry out their work.
The culture and tourism bureaus of all districts shall be responsible for the content filing, supervision and administration of secret rooms and cultural business units in their respective administrative regions.
Article 5 the business unit of secret room script killing cultural format shall establish and improve the content self-examination system, allocate content reviewers, implement corresponding technical supervision measures, and conduct self-examination and management of the content and activities such as scripts, scenes, clothes and props provided in the business, so as to ensure the legitimacy of the content and activities.
Article 6 the scripts used, scenes set, costumes and props provided by the business unit of secret room script killing cultural business shall not contain the following circumstances:
(1) violating the basic principles defined in the constitution;
(2) endangering national unity, sovereignty or territorial integrity;
(3) endangering national security or harming national honor and interests;
(4) inciting national hatred or discrimination, hurting national feelings or infringing on national customs and habits, and undermining national unity;
(5) propagating cults and superstitions in violation of state religious policies;
(6) propagating obscenity, pornography, gambling, violence and drug-related illegal and criminal activities, or abetting crimes;
(7) disturbing social order and undermining social stability;
(8) violating social morality or the excellent cultural tradition of the nation;
(9) insulting or slandering others and infringing upon the legitimate rights and interests of others;
(10) other contents prohibited by laws, regulations, rules and state regulations.
Article 7. In business activities, a business entity engaged in secret culture shall not commit any of the following acts:
(1) the way of performance and game is horrible, cruel, violent and vulgar, which destroys the physical and mental health of staff or consumers;
(2) using human defects or displaying human variation to attract consumers;
(3) performing by abusing animals;
(4) other acts prohibited by laws, regulations, rules and state regulations.
Article 8 business units of secret rooms and cultural businesses shall establish and improve the protection mechanism for minors and pay attention to the protection of minors’ physical and mental health. For the secret room killing activities that are not suitable for minors to participate, the business unit shall give a prompt at a prominent position or before the activities, and shall not allow minors to enter.
Article 9 the business unit of secret chamber script killing cultural business shall, within 30 days from the date of putting the script on the shelf, file and register the self reviewed script with the local culture and Tourism Bureau, and submit the following materials:
(1) script filing registration form;
(2) a copy of the business license;
(III) script (including story background, plot, character introduction and character dialogue);
(IV) copyright legality statement.
Article 10 in case of substantial changes in the story background, plot, role, dialogue and other contents of the script, the business unit of the cultural format of the secret room script shall re submit it for the record.
Article 11 the administrative department of culture and tourism shall strengthen the daily supervision and inspection of the business units of secret chamber scripts and cultural formats. If any violation of articles 6 and 7 of these Provisions is found during the inspection, it shall guide the business units to immediately remove the relevant scripts from the shelves and put them on the shelves after the relevant violations are eliminated; If other violations of laws and regulations are found, they shall be transferred to the relevant administrative departments for handling in time.
Article 12. The business unit of secret room culture shall adhere to the bottom line of production safety and content safety, operate in accordance with the law, compete fairly, actively cooperate with the supervision and management implemented by relevant government departments according to law, consciously accept social supervision and deal with complaints and reports in a timely manner.
Article 13 industry organizations shall actively promote industry self-discipline, resolutely resist low taste and stick to the bottom line of ideology; Carry out industry training to improve the ability and level of employees; Formulate industry standards and guide business units to carry out business activities in a standardized manner; Carry out credit evaluation and promote business units to improve service quality; Guide business units to deal with copyright disputes according to law, explore and establish a mediation mechanism for copyright disputes, and help business units safeguard their legitimate rights and interests.
Article 14 Where a business entity engaged in cultural business violates relevant laws and regulations such as public security, fire control and health, the relevant departments shall give guidance, management and punishment according to law.
Article 15 these Provisions shall enter into force as of March 1, 2022 and shall be valid until February 29, 2024.
