On January 12, 2022, the Bureau conducted law enforcement inspection on the parties concerned. The above-mentioned goods were identified as goods infringing the exclusive right to use a registered trademark by the trademark owner, and the bureau took compulsory measures to detain the above-mentioned goods on the spot. The party concerned cannot provide the purchase certificate or explain the legal supplier. Since the party concerned did not indicate the sales price on site, according to the market sales price provided by the relevant trademark owner: Wuliangye Yibin Co.Ltd(000858) 52 degrees 500ml / bottle 1399 yuan / bottle, Yanghe liquor: sea blue 52 degrees 480ml / bottle 170 yuan / bottle, sea blue 38 degrees 480ml / bottle 160 yuan / bottle, sky blue 52 degrees 480m / bottle 360 yuan / bottle, Dream Blue (M3) 52 degrees 500ml / bottle 550 yuan / bottle, Dream Blue (M6) 52 degrees 500ml / bottle 750 yuan / bottle, Chaoyang District Market Supervision Bureau determined that the value of the above commodities was 16602 yuan and the illegal business volume was 16602 yuan. The party concerned infringed four trademarks of ” Wuliangye Yibin Co.Ltd(000858) “, “sea blue”, “sky blue” and “Dream Blue”. Type of illegal act: item (3) of paragraph 1, Article 57 of the Trademark Law of the people’s Republic of China “selling goods infringing the exclusive right to use a registered trademark”.
According to relevant regulations, Beijing Chaoyang District Market Supervision Bureau ordered Beijing Chunnong Huaxia Trading Co., Ltd. to correct its illegal behavior, impose a fine of 10000 yuan and confiscate its illegal property.
