On the morning of the 28th, the Supreme People’s court approved the establishment of the Beijing International Commercial Court in the fourth intermediate people’s Court of Beijing as an institution specialized in hearing foreign-related commercial cases. This is the second local international commercial court in China.
Since 2018, Beijing No. 4 Intermediate People’s court has focused on the first instance of foreign-related commercial cases, commercial cases involving Hong Kong, Macao and Taiwan, arbitration judicial review cases and judicial assistance cases in Beijing, and foreign-related commercial cases and arbitration judicial review cases in Beijing, focusing on strengthening the trial function of foreign-related commercial cases, innovating the trial mechanism, and hearing more than 6000 foreign-related commercial cases, Involving more than 60 countries and regions, it has become an important force in foreign-related commercial trials in China, and has accumulated experience and laid a foundation for the establishment of Beijing International Commercial Court.
Cheng Hu, vice president of one belt, one Road Central Academy of Beijing, said that the Beijing International Commercial Court will give full play to Beijing’s outstanding advantages in the legal profession and international arbitration. It will closely integrate the “one belt and one road” construction, the opening up of a higher level and the Beijing’s “two districts” construction, and the Beijing Tianjin Hebei development requirements. Try international commercial cases in a timely and fair manner according to law, strive to improve the ability to resolve foreign-related commercial disputes, provide a market environment for Chinese and foreign parties to participate in open competition and be equally protected by law, and provide high-quality legal guarantee for the new development pattern of “five sons” linkage.
It is understood that the judges of Beijing International Commercial Court are selected by the fourth intermediate people’s court from senior judges who have rich trial experience, are familiar with international treaties, international practices and international trade and investment practice, and can skillfully use Chinese and English as working languages at the same time. At the same time, the fourth intermediate people’s court will take multiple measures to comprehensively promote the construction of foreign-related rule of law and the training of foreign-related rule of law talents. At present, two judges have been rated as advanced individuals in foreign-related commercial and maritime trials of national courts.
