Zeng Qinghong, a “veteran car maker”: special legislation to deal with intelligent driving

Zeng Qinghong, NPC deputy and Guangzhou Automobile Group Co.Ltd(601238) chairman, arrived in Beijing on the 4th to attend the upcoming fifth session of the 13th NPC. As a “veteran” in the automotive industry who has been addicted to “building cars” all his life, Zeng Qinghong is full of enthusiasm and sensitivity to new technologies. The motion he attended this meeting proposed that the relevant provisions of the road traffic safety law should be revised on “intelligent driving” and special legislation should be realized.

Zeng Qinghong’s work experience basically revolves around “making cars” and GAC. At the meeting, Zeng Qinghong brought one motion and five suggestions, covering the automotive industry and the national economy and people’s livelihood. The only motion directly pointed to the tuyere of the automotive industry – intelligent driving.

With the rapid increase in the penetration rate of new energy vehicles, intelligent driving has become the wind outlet of the industry from dream to reality. According to the data, in 2021, the financing amount of Chinese automatic driving related enterprises exceeded 40 billion yuan (RMB, the same below); At the beginning of 2022, there were more than 15 important investment and financing events in the field of unmanned driving outside China, and the total financing disclosed exceeded 6 billion yuan, including 13 Chinese enterprises.

The development of intelligent driving is in full swing, but it lacks legal protection. Zeng Qinghong said that the state plans to realize the large-scale production of intelligent driving vehicles by 2025, but intelligent driving vehicles have no “legal identity” so far, there are large gaps in relevant laws and regulations, it is difficult to promote road testing, and problems such as responsibility division must be solved before intelligent vehicles are officially launched in the future.

Guangzhou is one of the three major automobile production bases in China, and the automobile industry is one of the economic pillars of the city. Automatic driving has also become a new direction for Guangzhou’s automobile industry. The city has won the first of 9 automatic driving construction projects in China, including the first city to approve 5g remote driving test, the first city to issue passenger test license, etc. At present, 6 of the 11 districts in Guangzhou have 79 open test roads for intelligent Internet connected vehicles, with a total length of 156.29 kilometers.

Zeng Qinghong believes that there is no legal basis for the current intelligent driving vehicle on the road, and its subject of responsibility is different from traditional vehicles, so it is impossible to simply apply the current regulations for responsibility identification. Therefore, it is necessary to amend articles 2 and 76 of the road traffic safety law of the people’s Republic of China.

He suggested adding the definition of “machine driver” to help clarify the subject of responsibility for traffic accidents; Add the mandatory provision that “intelligent driving vehicles should be equipped with key data storage black boxes or cloud backup of key data”; On the basis of current traffic accident imputation, it is clear that the responsibility of intelligent system is borne by the producer; Add the provision of “bringing the liability insurance of intelligent driving automobile products into the scope of compulsory insurance and dispersing the risks of relevant responsible subjects”.

Zeng Qinghong stressed: “more importantly, we should make a breakthrough in intelligent driving legislation from scratch and start special legislation on intelligent driving.”
