Changchun: Full Score answer sheet for political procurement contract management

Reporter Niu Xiangjie and correspondent Zheng Shiyu reported that with the development of business environment assessment in China, contract management, as an important part of government procurement indicators, has become the focus of evaluation by local financial departments. In China's business environment assessment in 2020, the secondary index of government procurement "contract management" of Changchun City, Jilin Province won full marks and became the best in China.

According to the relevant person in charge of the government procurement management office of Changchun Finance Bureau, in terms of contract disclosure and change, Changchun Finance Bureau has strengthened management from contract signing and publicity, contract change compensation and contract addition, and strictly implemented the relevant provisions of the Ministry of finance. The procurement contract shall be signed by the purchaser and the winning supplier according to the matters determined in the procurement documents, and the purchaser and supplier shall perform their contractual obligations in strict accordance with the provisions of the contract; After the winning contract is signed, the purchaser is required to publicize it in the designated media within 2 working days.

"Changchun Finance Bureau has strictly supervised government procurement contracts and strengthened the supervision of contract disclosure and change. In particular, the signing and publicity of contracts are more standardized, and the contents of standardized contracts are more comprehensive and detailed, which provides great convenience for suppliers." Zhang Hongjia, manager of Beijing Zhongcheng Zhengxin Engineering Consulting Co., Ltd., told reporters.

In view of the non-uniform standards of government procurement contracts and the non-standard contract signing contents and formats, Changchun Finance Bureau and Changchun public resources trading center actively cooperated to distinguish according to the three categories of goods, projects and services, and formulate 20 types of standardized contracts according to different procurement methods. The standardized contract text focuses on many contract performance links, such as contract format, commercial terms, performance acceptance, payment method, liability for breach of contract, dispute resolution, etc., and embeds the standardized contract text into the procurement document, which is disclosed together with the procurement project information as a part of the standardized text of the procurement document.

"On the one hand, the timely disclosure of the contract gives us the opportunity to understand the gap between our unsuccessful projects and other companies, which helps to improve and improve our future work. On the other hand, the standardized text of the contract is diverse, and many basic terms can be determined without further negotiation with the purchaser, saving us a lot of time to participate in government procurement activities." Referring to the standardized text of the contract, Han Qingchun, manager of Changchun longtianwall human resources service outsourcing Co., Ltd., said.

The standardization of performance bond is also a highlight of Changchun Finance Bureau in contract management. Changchun Finance Bureau has made strict regulations on the payment method, reduction policy and return time of performance bond. As for the time of returning the performance bond, the Municipal Finance Bureau clearly requires that after the performance of the procurement project is completed and accepted, the purchaser shall confirm the supplier's application for returning the performance bond within 3 working days. For small and medium-sized enterprises, Changchun Finance Bureau also stipulates to cancel the contract quality guarantee for small and medium-sized enterprises and reduce the performance guarantee from 10% to 2% of the contract amount. Han Qingchun has a deep understanding of this. He said that at present, the company's participation in government procurement activities basically takes the form of submitting performance guarantee. In the past, the bid winning of a project required to pay a deposit of tens of thousands or even hundreds of thousands of yuan. Now it can be replaced by only one guarantee, which greatly reduces the capital occupation rate. For companies with good reputation, some projects do not even need to pay performance security.

In addition, whether the government procurement contract stipulates the method, time and conditions of fund payment, and clarifying the liability for breach of contract for overdue payment of funds is also an important content to measure contract management. Changchun Finance Bureau proposed that the purchaser pay the procurement funds in time in accordance with the relevant provisions of the Ministry of finance. If the supplier delays receiving the payment due to the purchaser, the purchaser will be investigated for breach of contract in accordance with the terms of overdue payment of funds agreed in the contract, and the purchaser's bad behavior will be included in the credit evaluation.

"We obviously feel that the number of suppliers participating in government procurement projects has increased, and the number of foreign suppliers consulting our government procurement business has also increased significantly, thanks to the optimization of the business environment of Changchun government procurement, the further strengthening of the openness and transparency of government procurement and the further expansion of market openness." The talent of the Finance Department of Changchun public security bureau said.
