>The 39 common app types listed in Article 5 of the notice (Guo Xin ban Mi Zi [2021] No. 14) are divided into two categories: collecting a wide range of necessary personal information and using basic functions without using personal information. According to the principle of “food, housing, travel, shopping and entertainment” which is closely related to consumers’ daily life, based on different app downloads, online car hailing There are 10 categories of instant messaging, online payment, online shopping, catering takeout, traffic ticketing, house rental and sale, car service, webcast and online audio and video. There are 5 apps in each category, with a total of 50 apps as the evaluation objects. The evaluation contents include whether the app account can be cancelled smoothly and unsubscribed automatically.
The evaluation results show that in terms of whether the app account can be successfully cancelled, 20 of the 50 apps have problems to varying degrees, accounting for 40% of the total troubleshooting proportion. The main problems are: first, the cancellation conditions are not specified. The app involved calls for Wanshun. Second, the setting of cancellation conditions is unreasonable. The apps involved are Dida travel, lily.com, wing payment, Taobao, happy shopping, hungry, McDonald’s, maple leaf car rental and 1905 film network. Third, the setting of cancellation process is unreasonable. Apps involved are soul, TT voice, China Southern Airlines Company Limited(600029) and Tencent video. Fourth, it can be cancelled only after manual audit, but there are situations in which no one accepts the manual audit, the commitment time limit is too long (more than 15 working days) or the commitment time limit is unclear. The apps involved are love shopping, Heshi takeout, China Southern Airlines Company Limited(600029) , mengguo and Baobao live broadcast. Fifth, it is impossible to log off directly through app. The apps involved are 6-person tour, Ctrip car rental and Tencent video.
According to the evaluation report, the cancellation page of tick trip (version No.: 8.15.1) shows that you cannot register again with your current mobile phone number within 90 days after cancellation.
Wing payment (version No.: 10.11.10) has two problems: the account information is outdated and cannot be cancelled. It can be cancelled only after the personal information is updated; Accounts that are less than a certain registration period cannot be cancelled.
According to the cancellation agreement of wing payment account, the cancellation shall meet the following conditions: 1 Account information or user information that is outdated, missing, incorrect or frozen cannot be applied for cancellation. At the same time, when you log off, you will be prompted that the account cannot be logged off temporarily if it has been registered for less than 24 hours.
Tencent video (version No.: 8.4.80.26419) has the problems of unreasonable cancellation process setting and unable to log off directly through app.
Tencent video account cancellation agreement:… Tencent video provides your account with a retention period of [15] days (i.e. “lock-in period”) After the lock period expires, if you do not receive your intention to cancel the cancellation or there are no other reasons not to cancel, the account will be permanently cancelled. At the same time, the logout page always displays system errors and cannot logout.
In view of the problems found in the evaluation, the China Consumer Association recommends that all app operators carefully carry out self inspection and rectification in accordance with the network security law, personal information protection law and other relevant laws, regulations, standards and specifications, express reasonable cancellation conditions, provide convenient cancellation paths, ensure the smooth cancellation of users’ accounts, and set up convenient automatic recommended unsubscribing methods, Continuously improve relevant user agreements and privacy policies.
China Consumer Association also reminds consumers that after accepting the personal information terms or providing personal information to operators, they should also pay attention to whether the operators’ personal information terms are modified, whether the operators have the ability to ensure the security of personal information, and whether the operators have illegal behavior of handling personal information. When consumers do not agree with the operator to continue processing their personal information, they should actively exercise the right to “withdraw their consent” and ask the operator to stop processing or delete their personal information in time.
In view of the problems found in this evaluation, the China Consumer Association will also send rectification suggestions within a time limit to the enterprises affiliated to app and conduct interviews. If relevant enterprises fail to rectify in time, the China Consumer Association will carry out follow-up supervision according to law.
