Because the case was detained on May 8, 2019, he was criminally detained on November 2 of the same year and arrested on November 8 of the same year.
The court ruled that the defendant Ma Yupeng committed the crime of taking bribes and was sentenced to fixed-term imprisonment of 13 years and 6 months and a fine of 3 million yuan. The proceeds from the crime of accepting bribes shall be confiscated according to law and turned over to the state treasury.

The judgment shows that from July 2017 to 2018, Ma Yupeng took advantage of his position as general manager of Kweichow Moutai Co.Ltd(600519) Liquor Sales Co., Ltd. to seek benefits for Maotai liquor dealer Du moujie and his wife CAI in signing and approving the retail of Maotai liquor. Du moujie promised to give RMB 27.3 million, and then Ma Yupeng arranged Du moujie and CAI to keep it on behalf of him.
Du moujie testified that on one day in June 2017, he and Ma Yupeng agreed to ask Ma Yupeng to sign some approval notes for sales, and the profit he earned was divided by half with Ma Yupeng. Ma Yupeng agreed at that time.
Around August, because Du moujie had been away for a long time, his wife Cai went to Ma Yupeng for signature. Since July 2017, he and Cai will take more than ten approval notes to Ma Yupeng every month. The approval notes signed by Ma Yupeng are handed over to driver Liu mouhong to deal with relevant business and sales. Until the beginning of 2018, Maotai liquor sales company gradually restricted the signing and approval of retail approval notes. After January, Ma Yupeng basically didn’t sign approval notes.
After Ma Yupeng stopped signing the approval note, his wife Cai told him that from July 2017 to January 2018, he and Cai made a total profit of 54.6 million yuan from the operation and sales signed by Ma Yupeng. According to the commitment of 50% to Ma Yupeng in advance, they should take out 27.3 million yuan to Ma Yupeng.
In the second half of 2018, he told Ma Yupeng and his ex-wife Liu about the 27.3 million yuan he wanted to give Ma Yupeng, and proposed to give them the money. Cai said that she also told Liu. In 2018, he prepared to partner with Mou mouqiang to open a house. From these profits, he transferred RMB 47 million to Mou mouqiang, and Cai also transferred RMB 10 million to Mou mouqiang.
Ma Yupeng confessed that in the second half of 2018, according to the prior agreement, Du moujie told him that more than 27 million yuan of the sales profit of the approval slip was given to him, and proposed to give the money to him. He said he didn’t need the money urgently, so he kept how much of it. As the general manager of Maotai liquor sales company, he knows that the exchange of more than 27 million yuan with Du moujie is against discipline and law. If he or his relatives suddenly receive such a large amount of money, he is worried that once someone investigates it, it is not safe to deposit the cash, so he thinks it is the safest to put it there. Relevant evidence confirmed that in July 2018, Chen Mou Jun signed a private fund contract with Shenzhen supreme Quantitative Investment Management Co., Ltd. Guotai Junan Securities Co.Ltd(601211) and subscribed for the No. 3 private fund of Shenzhen supreme Quantitative Investment Management Co., Ltd. of RMB 30 million. On July 18, 2019, Chen Moujun redeemed the subscribed fund balance of RMB 27.462 million.
It was confirmed that on May 28, 2019, Chen Jun made a profit of 40 million yuan from Maotai liquor signed and approved by Ma Yupeng, of which 20 million yuan was kept on behalf of Ma Yupeng.
Chen confirmed that in order to thank Ma Yupeng for signing and approving the wine, he gave Ma Yupeng a total of 23.14 million yuan. Give Ma Yupeng 640000 yuan in cash in three times. Ma Yupeng is responsible for the sales of a batch of Yupeng liquor in July 2016, and Ma pingtian is responsible for the profit. From July 2016 to the second half of 2018, Ma Yupeng signed and approved the wine, and made a profit of more than 45 million yuan after sales. In the first half of 2017 and early 2019, Ma Yupeng received 200000 yuan in cash from pan Mouxiang twice.
17. Ma Yupeng took advantage of his position as general manager of Kweichow Moutai Co.Ltd(600519) Liquor Sales Co., Ltd. to seek benefits for Luo Yijun, a Maotai liquor dealer, in matters such as Maotai liquor operation, signing and approving the retail of Maotai liquor. In the second half of 2017, he received Luo Yijun’s cash of 50000 yuan.

Ma Yupeng took advantage of his position as general manager of Kweichow Moutai Co.Ltd(600519) Liquor Sales Co., Ltd. to seek benefits for Maotai liquor dealer Wang mouxin in Maotai liquor operation, signing and approving retail Maotai liquor and other matters.
