notice of the Ministry of industry and information technology and the Ministry of natural resources on Issuing the first batch of total amount control indicators for rare earth mining, smelting and separation in 2022
Relevant departments in charge of industry and information technology and natural resources of provinces and autonomous regions, China Rare Earth Group Co., Ltd., China Northern Rare Earth (Group) High-Tech Co.Ltd(600111) , Xiamen Tungsten Co.Ltd(600549) and Guangdong Rare Earth Industry Group Co., Ltd.:
The first batch of total amount control indicators for rare earth mining, smelting and separation in 2022 are hereby issued to you. Relevant matters are notified as follows:
I. rare earth is a product of the state’s total production control and management. No unit or individual may produce without or beyond the target. In 2022, the total control indexes of the first batch of rare earth mining, smelting and separation are 100800 tons and 97200 tons respectively.
II. After the issuance of the indicators, each rare earth group shall timely consult with the competent department of industry, informatization and natural resources of the province (autonomous region) where the subordinate enterprise is located, complete the decomposition and issuance of the indicators within 10 working days, and report to the Ministry of industry and informatization and the competent department of industry and informatization of the province (autonomous region) for the record. At the same time, the list of mines in production (including engineering construction projects for recycling rare earth) and all smelting and separation enterprises in the current year shall be publicized on the portal websites of each group.
III. indicators shall be allocated to key backbone enterprises with advanced technology and equipment and high level of safety and environmental protection. Enterprises under one of the following circumstances shall not be allocated indicators:
(1) the mining enterprise has no mining license or safety production license, and the projects of recycling rare earth resources that exceed the approval period or the relevant departments explicitly request to stop production for rectification;
(2) the rare earth smelting and separation enterprise uses the backward production process and smelting and separation capacity that has been listed in the prohibited or eliminated catalogue, and the smelting and separation capacity is less than 2000 tons (converted into rare earth oxide) / year, or the relevant department explicitly requests to stop production for rectification;
(3) failing to meet the environmental protection requirements such as the emission standard of pollutants for rare earth industry (GB 26451-2011) and radioactive protection;
(4) failing to meet the management requirements of tailings pond such as the provisions on safety supervision and management of tailings pond;
(5) long term shutdown without production conditions.
IV. each rare earth group shall strictly abide by relevant laws and regulations on environmental protection, resource development and safe production, organize production according to indicators, and continuously improve the level of technology, cleaner production and the conversion rate of raw materials; It is strictly prohibited to purchase and process illegal rare earth mineral products and carry out agent processing (including entrusted processing) of rare earth products; Comprehensive utilization enterprises shall not purchase and process rare earth mineral products (including imported mineral products); The utilization of overseas rare earth resources shall strictly abide by the relevant administrative provisions on the import and export of mineral products.
V. the competent departments of industry, informatization and natural resources of relevant provinces (autonomous regions) should cooperate closely, further strengthen communication, coordination and information sharing, improve the ability of administration according to law, make full use of information means such as traceability system, dispatch and inspect the index implementation of enterprises within their jurisdiction on a monthly basis, carry out random sampling from time to time, and report the sampling results in time.
Vi. all rare earth groups must report the implementation of indicators on time, speed up the construction of internal product traceability system, and shall not falsely report, conceal or change data at will.
VII. Rare earth group is requested to report the production data of last month (including the data filling of traceability system) to the Ministry of industry and information technology before the 10th day of each month (postponed on holidays) according to the requirements of the dispatching report.
