Chapter I General Provisions
Article 1 in order to conscientiously implement the main responsibility of production safety of production and business operation entities, strengthen the safety emergency work of enterprises, prevent, reduce and control various accidents (events), organize and implement disaster prevention, mitigation and disaster relief, effectively respond to various emergencies and ensure the safety of life and property, According to the production safety law of the people’s Republic of China, the emergency response law of the people’s Republic of China, the fire protection law of the people’s Republic of China, the emergency regulations for production safety accidents, the regulations of Heilongjiang Province on production safety, the provisions on the main responsibility of production and business operation units in Heilongjiang Province, the measures for the implementation of fire safety responsibility system in Heilongjiang Province and other laws and regulations and Heilongjiang Agriculture Company Limited(600598) This system is formulated in accordance with the relevant provisions of the emergency work management measures of Nongken Group Co., Ltd. (revised in 2021) and in combination with the actual situation of the company.
Article 2 this system is applicable to the safety emergency work of the company and its subsidiaries and wholly-owned or holding subsidiaries (hereinafter referred to as “branches and subsidiaries”). Where laws and regulations provide otherwise, such provisions shall prevail.
Article 3 the company’s safety emergency work includes all work related to safety and emergency, such as safety production, fire safety, disaster prevention, reduction and relief and emergency management of various emergencies.
Article 4 the work of production safety shall adhere to the leadership of the Communist Party of China. We should be people-oriented, adhere to the people first and life first, put the protection of people’s life safety in the first place, establish the concept of safe development, adhere to the policy of safety first, prevention first and comprehensive treatment, and prevent and resolve all kinds of safety risks from the source. Article 5 the company and its branches and subsidiaries are the main body responsible for production safety, earnestly implement the provisions on the main responsibility of production safety of production and business units in Heilongjiang Province, establish corresponding mechanisms, and strengthen and implement the organizational guarantee responsibility, rules and regulations guarantee responsibility, fund guarantee responsibility, education and training guarantee responsibility, safety management guarantee responsibility, accident report and emergency rescue.
Article 6 the company and its branches and subsidiaries must abide by national laws and regulations on production safety, fire safety and emergency response, and have the conditions for production safety specified in relevant laws, administrative regulations, national standards, industrial standards or local standards. Those who do not have the conditions for production safety shall not engage in production and business activities.
Where an administrative license is required for production and operation activities according to law, it shall apply to the relevant departments according to law and obtain the corresponding license qualification before engaging in production and operation activities. Article 7 the safety emergency work of the company and its branches and subsidiaries shall strictly implement the principles of “the same responsibility of the party and the government, one post and two responsibilities, joint management and accountability for dereliction of duty” and “the management of the industry must be in charge of safety, the management of business must be in charge of safety, and the management of production and operation must be in charge of safety”, strengthen the organization and leadership of safety emergency work, improve the safety production responsibility system, and coordinate the development and safety, Ensure the “five in place” of safety responsibility, safety investment, safety training, safety management and emergency rescue, and promote the synchronous and coordinated development of safety production and economy and society.
Article 8 the company and its branches and subsidiaries shall, in combination with their own reality, establish and improve the safety production responsibility system, safety production rules and operating procedures, establish safety production prevention and control system and emergency rescue system, strictly implement the safety production responsibility system and strengthen safety production management.
Article 9 the company and its branches and subsidiaries shall increase the investment and guarantee of production safety funds, materials, technology and personnel, improve production safety conditions, strengthen the standardization and information construction of production safety, strengthen the construction of safety culture, build a dual prevention mechanism of hierarchical management and control of safety risks and troubleshooting and treatment of hidden dangers, improve the risk prevention and resolution mechanism, and improve the level of production safety, Ensure safe production.
Article 10 branches and subsidiaries shall make analysis, research and judgment according to the risk situation of emergencies of their own units, formulate emergency plans according to the characteristics and hazards of possible emergencies such as natural disasters, production safety accidents and social security events, implement preventive and response measures, and establish full-time or part-time emergency teams in accordance with relevant regulations, Equip necessary emergency rescue equipment and materials, update and supplement them in time, effectively prevent and reduce losses and social impact caused by various emergencies, and ensure the safety of employees’ lives and property. The possible emergencies and safety precautions taken by the unit shall be reported to the company, the group branch and the relevant departments of the local people’s Government in time in accordance with the regulations.
Article 11 the safety emergency work of branches and subsidiaries shall be subject to the management of local group branches and local governments, and the “double reporting” system of emergencies shall be strictly implemented. In case of production safety accidents or natural disasters and other emergencies, the emergency plan shall be started immediately to carry out self-help work, and timely report to the group branches Local government and company reports.
Article 12 all employees of the company have the right to obtain production safety guarantee according to law, and shall perform their obligations in production safety according to law.
The trade union of the company and its branches and subsidiaries shall supervise the safety emergency work according to law, support the trade union to organize employees to participate in the democratic management and democratic supervision of the safety emergency work of the unit according to law, and safeguard the legitimate rights and interests of employees in production safety. When the unit formulates or modifies relevant production safety rules and regulations, it shall listen to the opinions of the trade union.
Chapter II Organization and responsibilities
Article 13 Party organizations at all levels of the company shall take safety emergency work as an important part of the assessment of Party organizations and their leading groups and leading cadres, establish and improve the assessment, reward and punishment mechanism of safety emergency work, and seriously organize its implementation. The main person in charge of each unit is the first person responsible for the safety emergency work of the unit and is fully responsible for the safety emergency work of the unit. The person in charge is specifically responsible for the safety emergency work, and other persons in charge are responsible for the safety emergency work within their scope of responsibility.
Article 14 the company and its branches and subsidiaries shall establish a safety emergency committee with the main person in charge as the director, the person in charge of safety emergency work as the executive deputy director, other members of the team and the person in charge of safety emergency management department as the deputy director, and the heads of relevant safety emergency industry departments as the members.
Article 15 responsibilities of safety emergency committee
The safety emergency committee is the leading and decision-making body of the company’s safety emergency work, which is responsible for studying, deliberating and deciding on major matters related to the company’s emergency work such as safety production, fire safety, disaster prevention, disaster reduction and relief, flood control and drought relief; Implement laws, regulations, rules and other provisions related to production safety, fire safety and emergency work; Implement the decisions and arrangements of the group and other superiors on safety emergency work, and coordinate and solve major problems of safety production, fire safety and emergency work; Organize, guide and coordinate relevant industrial departments to implement work safety, fire safety and emergency management.
(i) Study and determine the company’s safety emergency work development plan, annual plan and phased safety emergency work arrangement according to relevant safety emergency laws, regulations, industrial and local standards, specifications and policy documents, organize the formulation of implementation plans, methods and measures to strengthen safety emergency work, and be responsible for guidance, supervision, inspection and implementation;
（2） Supervise, inspect and guide the safety emergency work of all branches and subsidiaries, and urge relevant units to implement rectification measures and timely rectify the existing problems and hidden dangers;
（3） Organize the company’s comprehensive and special safety emergency work inspection and assessment, and timely hold special meetings to study and solve major problems in safety emergency work;
（4） Supervise the formulation and implementation of safety emergency investment plans of branches and subsidiaries; （5） Organize and guide branches and subsidiaries to formulate emergency plans for various emergencies, and carry out training and drills;
（6） Establish an assessment mechanism, carry out the assessment of safety emergency work, study and decide on the commendation, reward, punishment and other matters related to safety emergency work, strictly implement the “one vote veto” system, take the implementation of safety emergency work as the pre condition for the evaluation, model selection and cadre promotion assessment of each unit, and timely summarize and promote the special practices and experience in safety emergency work;
（7） In principle, a plenary meeting shall be held at least once a quarter to analyze the situation, study, deploy and supervise the implementation of key safety emergency work and major matters, and solve key and difficult problems in safety emergency work;
（8） Accept the inspection, supervision and guidance of relevant superior departments on safety emergency work.
Article 16 the office of the safety emergency committee is located in the safety emergency office of the company, which is specifically responsible for the daily work of the safety emergency committee. Implement the decision-making and deployment of the safety emergency committee, and be responsible for organizing the implementation, supervision and inspection; Prepare and hold the meeting of safety emergency committee; Coordinate and urge all member units to implement the decision-making and deployment of safety emergency work; Organize and carry out safety emergency work assessment and other work assigned by the emergency committee.
Article 17 the company and its branches and subsidiaries shall set up safety emergency management organizations according to law and allocate full-time (Part-time) safety emergency management personnel in accordance with relevant regulations. The safety emergency management organization (Department) is the comprehensive supervision and Management Department of the safety emergency work of the unit. It performs the responsibilities of internal safety emergency management, is responsible for the specific organization, implementation, supervision and inspection of safety emergency work, undertakes the safety emergency supervision in the industry within the scope of responsibility, and undertakes the daily work of the safety emergency committee.
Article 18 all industrial departments of the company and its branches and subsidiaries shall be responsible for the safety emergency work in their respective industries according to the requirements that the industry must be in charge of safety, clarify the division of responsibilities of department members for safety emergency work, and earnestly perform the responsibilities of safety emergency work. The safety emergency management department and various industrial departments shall cooperate with each other, jointly manage, share information and resources, and strengthen the safety emergency work. Other relevant departments shall provide support and guarantee for safety emergency work in combination with their own responsibilities.
The management personnel at all levels and other employees of the company and its branches and subsidiaries shall perform corresponding safety emergency responsibilities in accordance with the provisions of the safety emergency responsibility system of the unit. Article 19 the main principals of the company and its branches and subsidiaries are fully responsible for the safety emergency work of the unit, and specifically perform the following responsibilities:
（1） Establish, improve and implement the safety production responsibility system of all employees of the unit, and strengthen the construction of safety production standardization;
（2） Organize the formulation, revision and implementation of the safety production management system and safety operation procedures of the unit;
（3） Organize the formulation and implementation of work safety education and training plans of the unit; （4） Ensure the effective implementation of safety emergency investment of the unit;
（5） Organize the establishment and implementation of the dual prevention mechanism of hierarchical control of safety risks and troubleshooting and treatment of hidden dangers, supervise and inspect safety production work, and eliminate accident hidden dangers in time;
（6） Fulfill the provisions on the simultaneous design, construction, production and use of the safety facilities of the construction project and the main project of the unit (hereinafter referred to as “three Simultaneities”);
（7） Set up the safety emergency management organization of the unit according to law and allocate sufficient safety emergency management personnel, implement the safety functions of the technical management organization of the unit and allocate safety technicians;
（8） Organize the formulation, revision and implementation of emergency plans for production safety accidents and other emergencies of the unit;
（9） Timely and truthfully report production safety accidents and other emergencies;
（10） Regularly study the safety emergency work and report the safety emergency work to the employee congress, employee congress or shareholders’ meeting;
（11） Organize and implement flood control, drought relief and rescue work;
（12） Other duties stipulated by laws, regulations and rules.
Article 20 the safety emergency management organization and safety emergency management personnel of the company and its branches and subsidiaries shall strictly abide by their duties and perform their duties according to law. Perform the following duties:
（1） Organize or participate in the formulation of work safety rules and regulations, operating procedures and emergency plans for work safety accidents, natural disasters and other emergencies of the unit, supervise and inspect the implementation, and organize the implementation of emergency training and drills of the unit;
（2） Put forward the safety emergency work plan and fund use plan of the unit and organize their implementation;
（3） Organize or participate in the work safety publicity, education and training of the unit, and truthfully record the work safety education and training;
（4） Check the safety production status of the unit, timely investigate the hidden dangers of production safety accidents, put forward suggestions to improve the safety production management, stop and correct the illegal command, forced risky operation and violation of operating procedures, organize the identification and evaluation of hazard sources, and urge the implementation of the safety production rectification measures and safety management measures of major hazard sources of the unit;
（5） Supervise and inspect the “three Simultaneities” of safety facilities of construction projects of the unit; （6） Supervise and guide the unit to sign safety production management agreements with contractors, lessees, collaborators and other units, and supervise and inspect their performance of safety production responsibilities;
（7） Supervise the purchase, distribution, use and management of labor protection articles of the unit, and supervise and inspect the employees to wear and use labor protection articles correctly;
（8） Establish an early warning and disaster reporting system, improve the acquisition and sharing mechanism of natural disaster information resources, and release early warning and disaster information within the unit; （9） Guide and coordinate the emergency rescue of emergencies of the unit according to the principle of hierarchical response. Establish an emergency coordination and linkage mechanism to cooperate with the group branch, the farm and the government to do a good job in emergency rescue involving emergencies of the unit. Organize the construction of emergency rescue force of the unit. Be responsible for the overall management of emergency relief materials of the unit, and organize and coordinate the allocation of important emergency materials;
（10） Organize and implement the management and training of full-time and part-time emergency teams of the unit;
（11） Cooperate with the group branch, the farm and the government in disaster prevention, reduction and relief of the unit;
（12） Organize or participate in the investigation and handling of production safety accidents of the unit according to law; Cooperate with the government accident investigation team to investigate and deal with production safety accidents, be responsible for accident statistics, analysis and report, and cooperate with the accident investigation team
